Abu Bakr’s claim of consensus (ijmaa) on Fadak is pointless

The topic of Fadak and the bigger debate on the inheritance of divine Prophets (a.s.) is among the key and earliest distinguishing points between the Shias and others.
The majority claims that Hazrat Fatima Zahra (s.a.) – the Holy Prophet’s (s.a.w.a.) daughter – had no right to Fadak because Allah’s Prophets (a.s.) do not leave behind inheritance.
To bolster their claim, they resort to the age-old formula of consensus (ijmaa) – meaning that the so-called Muslim majority and companions supported Abu Bakr in his claim that divine Prophets (a.s.) do not leave behind inheritance. This supposed consensus against Hazrat Fatima Zahra (s.a.) proves that Abu Bakr was right and Hazrat Fatima (s.a.) had no claim over Fadak.
Reply
There are many aspects to this debate and there are several ways to prove that Abu Bakr was mistaken like on many other occasions in his life, a fact already been established by scholars of both sects; thereby establishing Hazrat Fatima’s (s.a.) indisputable claim to Fadak.
We adopt another approach to this debate as suggested by a well-known Muslim scholar to prove that the argument of consensus of Abu Bakr is nullified by a similar argument in Hazrat Fatima’s (s.a.) favour.
Al-Jaahiz’s stand on the dispute over Fadak
Abu Usman al-Jaahiz, a well-known teacher and thinker of the Ahle Tasannun quotes Sayyid al-Murtaza Alam al-Hoda (r.a.):
The people (companions) presume that the veracity of the so-called tradition of the Holy Prophet (s.a.w.a.) narrated by the two men, meaning Abu Bakr and Umar that – ‘We the Prophets do not leave anything as inheritance’, can be established on the basis that when this was attributed to the Prophet (s.a.w.a.), the Muslims did not refute it – rather they accepted it.
But I (Jaahiz) say to those men who think likewise that if the veracity of this ‘tradition’ is proved because the people accept it (thereby signifying consensus), then the people did not even object against the claim and the protest of Ali (a.s.) and Fatima (s.a.), and this should also be a proof of their (Ali a.s. and Fatima’s s.a.) truthfulness.
No one objected to them, nor said that they were lying, even though the dispute and discussion between Fatima (s.a.) and Abu Bakr was prolonged.
Their enmity reached to an extent that Fatima (s.a.) willed that Abu Bakr should not even participate in her funeral prayers.
When Fatima (s.a.) approached Abu Bakr to claim her right, she demanded – When you die, who will inherit you?
Abu Bakr replied – My family and my children.
Fatima (s.a.) responded – How is it that we should not inherit from the Prophet (s.a.w.a.), but your children inherit from you?
When Abu Bakr prevented Fatima (s.a.) from claiming her father’s inheritance and started making excuses and when Fatima (s.a.) witnessed his cruelty and saw her own helplessness and loneliness, she rebuked Abu Bakr: By Allah! I will invoke Allah’s curse on you.
Abu Bakr – By Allah! I will invoke Allah for your well-being.
Fatima (s.a.) – By Allah! I will never speak with you from now on
Abu Bakr – By Allah! I will never be away from you.
Therefore, if the ‘truthfulness’ of Abu Bakr deprived Hazrat Fatima (s.a.) from her father’s inheritance can be established on the grounds that the companions did not protest against him, then it can be said that Hazrat Fatima (s.a.) was also truthful in her claim (since no one protested against her either).
The least that was necessary for the Muslims was that if Hazrat Fatima (s.a) was unaware (of the rule of Islam), then they should have explained it to her, and if she had forgotten, then they should have reminded her. If her talks were baseless (we seek refuge in Allah!) or she was going astray or severing relations, then they should have rectified her by protesting.
Thus, it can be concluded that if no one protested against those two men, and no one even protested against Hazrat Fatima (s.a.) – then the two parties are at par in opposing each other and no one can argue on the basis of consensus in favour of Abu Bakr (because Fatima (s.a.) can likewise claim consensus for her stand!).
In this matter, we should refer to the original rules of inheritance and ordinances of Allah (in the Holy Quran) regarding the matter of inheritance, and this is the best mode to follow.
  • Al-Shafi v. 1 p. 233 of Sayyid al-Murtaza (r.a.)
  • Bait al-Ahzan pp. 165-167
Clearly, even the earliest scholars of the Ahle Tasannun were of the view that the consensus on Fadak was not a strong argument in Abu Bakr’s favour. Given that consensus can be claimed by both parties, the only way to break this deadlock is with the Holy Quran’s ordinance on inheritance. Hazrat Fatima Zahra (s.a.) herself has laid out plainly in the Sermon on Fadak that the Holy Quran has categorically stated that fathers leave inheritance for their children and even divine Prophets like Prophet Dawood (a.s.) and Prophet Zakariyya (a.s.) left inheritance for their progenies.
Take lesson, O people of intellect!

SCANNED REFERENCES ABOUT 9TH RABI UL AWAL - EID E ZEHRA - REFERENCE NUMBER 4

As for performing ablution on the ninth day of Rabi'ul-Awwal, it has been told that this was the act of Ahmad, son of Ishaq Al-Qummi, (the companion of Al-Askari (a.s)), because it was a day of Eid as mentioned in the narrations on the issue that causes happiness for the believers and grief for the hypocrites. And I have found a narration whose chain of narrators on the authority of the Prophet (saw) about the virtue and the blessing of this day, and which states that it is a day of joy for them (a.s) to such a degree that one's mind is amazed. This issue is detailed, and there is a statement on this due to that matter which coincides on this day. Hence we might say that performing an ablution during this day is recommendable based on its recommendation on events such as this, and especially since this day is an Eid for us and our Imams (a.s).

SCANNED REFERENCES ABOUT 9TH RABI UL AWAL - EID E ZEHRA - REFERENCE NUMBER 3

Sayed ibn Tawoos (D.654 A.H):

I know that we found a narration with a great value concerning this day, and we found a group of Persians and several brothers glorify their joy during it. They remind that it is the day of the death of a person who used to belittle the value of Allah (Glorious be His glory) and His Messenger (may Allah's blessings be upon him and his family) and antagonise him. So far I have not found a conformity in any of the books I have read to the narration that we have narration on the authority of Ibn Babawayh (r.a). If anyone wishes to totally glorify this day due to the secret it contains, and not due to the appearance of it, as a precaution to the narration, then this is a habit we have maintained

SCANNED REFERENCES ABOUT 9TH RABI UL AWAL - EID E ZEHRA - REFERENCE NUMBER 2

Source: Zaad Al-Mi'aad. Pg. # 257 - 258.

The author (i.e. Al-Majlisi II) says: It becomes clear from the narration of this great Sheikh the merits of this day and the occurrence of this blessed event in it, such that it has been narrated many narrations about it and it was famous among Shia in those old times. And to my knowledge there has not been narrated anything in contradiction to it and the consensus of the Sunni historians is not acceptable as contradiction against reliable narrations.

The House of Fatema Zahra (sa) .... The Hijaab of Allah (swt)

From" Kitab al-Turf" of Sayed ibn Taoos quoting from Kitab al-Wassiyah of Shaikh Isa bin al-Mustafaad al-Zareer from Imam Musa bin Jafar al-Kazim (as) from his Father (as):

"When Prophet Mohammad (saww) was about to die, He called the Ansaar's and said, ... "Indeed the door of Fatema (sa) is My door, and Her house is My house. So whoever disgraces it has disgraced the Hijaab (veil/covering) of Allah (swt)."

The narrator Isa then says, "Abu al-Hasan Imam Kazim (as) then cried for long and cut of rest of his speech and said, "By Allah (swt) the Hijaab of Allah (swt) was disgraced, By Allah (swt) the Hijaab of Allah (swt) was disgraced, By Allah (swt) the Hijaab of Allah (swt) was disgraced, O My Mother (sa)..."

THE HISTORIC SERMON OF GHADEER E KHUM OF THE HOLY PROPHET (SAWS)

PROPHET'S HISTORIC GHADlR SERMON
There is a humble translation of the Prophet's historic Ghadir Khumm sermon. The reader can review the original Arabic text included in this book.
All Praise is due to Allah Who is Exalted in His Unity, Near in His Uniqueness, Sublime in His Authority, Magnanimous in His Dominance. He knows everything; He subdues all creation through His might and evidence. He is Praised always and forever, Glorified and has no end. He begins and He repeats, and to Him every matter is referred.
Allah is the Creator of everything; He dominates with His power the earth and the heavens. Holy, He is, and Praised, the Lord of the angels and of the spirits. His favours overwhelm whatever He creates, and He is the Mighty over whatever He initiates. He observes all eyes while no eye can observe Him. He is Generous, Clement, Patient. His mercy encompasses everything, and so is His giving. He never rushes His revenge, nor does He hasten the retribution they deserve. He comprehends what the breast conceals and what the conscience hides. No inner I thought can be concealed from Him, nor does He confuse one with another. He encompasses everything, dominates everything, and subdues everything. Nothing is like Him. He initiates the creation from nothing; He is everlasting, living, sustaining in the truth; there is no god but He, the Omnipotent, the Wise One.
He is greater than can be conceived by visions, while He conceives all visions, the Eternal, the Knowing. None can describe Him by seeing Him, nor can anyone find out how He is, be it by his intellect or by a spoken word except through what leads to Him, the Sublime, the Mighty that He is.
I testify that He is Allah, the One Who has filled time with His Holiness, the One Whose Light overwhelms eternity, Who effects His will without consulting anyone; there is no partner with Him in His decisions, nor is He assisted in running His affairs. He shaped what He made without following a preexisting model, and He created whatever He created without receiving help from anyone, nor did doing so exhaust Him nor frustrated His designs. He created, and so it was, and He initiated, and it became visible. So He is Allah, the One and Only God, the One Who does whatever He does extremely well. He is the Just One Who never oppresses, the most Holy to Whom all affairs are referred.
I further testify that He is Allah before Whom everything is humbled, to Whose Greatness everything is humiliated, and to Whose Dignity everything submits. He is the King of every domain and the One Who places planets in their orbits. He controls the movements of the sun and of the moon, each circles till a certain time. He makes the night follow the day and the day follow the night, seeking it incessantly. He splits the spine of every stubborn tyrant and annihilates every mighty devil.
Never has there been any opponent opposing Him nor a peer assisting Him. He is Independent; He never begets nor is He begotten, and none can ever be His equal. He is One God, the Glorified Lord. His will is done; His word is the law. He knows, so He takes account. He causes death and gives life. He makes some poor and others rich. He causes some to smile and others to cry .He brings some nearer to Him while distancing others from Him. He withholds and He gives. The domain belongs to Him and so is all the Praise. In His hand is all goodness, and He can do anything at all.
He lets the night cover the day and the day cover the night; there is no god but He, the Sublime, the oft-Forgiving One. He responds to the supplication; He gives generously; He computes the breath; He is the Lord of the jinns and of mankind, the One Whom nothing confuses, nor is He annoyed by those who cry for His help, nor is He fed-up by those who persist. He safeguards the righteous against sinning, and He enables the winners to win. He is the Master of the faithful, the Lord of the Worlds Who deserves the appreciation of all those whom He created and is praised no matter what.
I praise Him and always thank Him for the ease He brings me and for the constriction, in hardship and in prosperity, and I believe in Him, in His angels, in His Books and messengers. I listen to His Command and I obey, and I initiate the doing of whatever pleases Him, and I submit to His decree hoping to acquire obedience to Him and fear of His penalty, for He is Allah against Whose designs nobody should feel secure, nor should anyone ever fear His "oppression."
I testify, even against my own soul, that I am His servant, and I bear witness that he is my Lord. I convey what He reveals to me, being cautious lest I should not do it, so a catastrophe from Him would befall upon me, one which none can keep away, no matter how great his design may be and how sincere his friendship. There is no god but He, for He has informed me that if I do not convey what He has just revealed to me in honor of' Ali in truth, I will not have conveyed His Message at all, and He, the Praised and the Exalted One, has guaranteed for me to protect me from the (evil) people, and He is Allah, the One Who suffices, the Sublime. He has just revealed to me the following (verse):

Prediction of the Messenger of Allah (s) about martyrdom of Lady Fatima Zahra (s) in Ahle Sunnat sources

Discussion about the attack on the house of revelation and martyrdom of the Lady of the two worlds, Her Eminence, Fatima Zahra (s) has started again after sometime. It can be concluded from reliable traditional reports that this matter, for the first time, was mentioned by the Holy Prophet (s). For example, it is possible to reason through the following report about which we shall discuss in detail at a later stage:

Juwaini[1] (d. 730 A.H.) – Ahle Sunnat scholars call him Imam of the Two sanctuaries (Imamul Harmain) and Imam Juwaini and is having a position of a person like Dhahabi[2]; he has narrated from the Messenger of Allah (s) as follows:

When I see Fatima (s), I am reminded of the tragedies that are to befall her after my passing away. As if I can see with my own eyes, that disrespect has entered her house, her sanctity is destroyed, her right has been usurped; she is deprived of her inheritance, her side is broken and her unborn son is killed in the womb; she wails: O Muhammada, but no one comes for her rescue…Fatima would be my first family member to join me after being aggrieved and oppressed and after being martyred.[3]

[1] Juwaini’s position according to Ahle Sunnat:
Dhahabi has mentioned his teacher, Juwaini as follows:
“Juwaini is Imam, leader, extraordinary and perfect traditionist, pride of Islam and an honest and righteous person.
Tadkirah Huffaz, Vol. 4, Pg. 1, No, 1. Teachers of the author of Tadkirah, Abu Abdullah Shamsuddin Muhammad Dhahabi (d. 748 A.H.), Darul Kutub Ilmiya, Beirut, First edition.
In the same way, he says in another place:
He is the Imam of traditional reports and traditions, uniquely perfect, source of pride for Islam, chief of religion, Ibrahim bin Muhammad bin Mobad bin Hamya Khorasani Juwaini…according to traditional reports and available books of traditions, he is having much importance. He had a nice voice, elegant face, he is awesome and religious.
Tadkiratul Huffaz, Vol. 4, Pg. 1, No. 24, Abu Abdullah Shamsuddin Muhammad Dhahabi (d. 748 A.H.), Darul Kutub Ilmiya, Beirut, First edition.
[2] Dhahabi’s position according to Ahle Sunnat:
Dhahabi is an incomparable personality among scholars of Ahle Sunnat, a very lofty position and high rank of a rare kind. He was born in 673 A.H. in the Kufr Batna province in the area of Damascus (d. 748 A.H.), he was able to learn traditions by heart and he dedicated his whole life to it. Views of Dhahabi are considered very reliable in most tradition and history books and he is called as the historian of Islam and Imam of traditionists. Sobki has written about him:
Dhahabi is the traditionist of the time, leader of the memorizers of traditions, he was aware of the various aspects of the science of traditions; he was the standard bearer of Ahle Sunnat wal Jamat, leader of his time in the science of memorization and criticism of traditions; he was a unique personality of his times; and all have admitted to his capabilities.

OBJECTIONS AGAINST HAZRAT FATEMAH ZAHRA (SA) AND THEIR REPLIES - OBJECTION NO 16 PART 2

Objection 16 : Did the Messenger of

Allah (s) possess sonography facility?

CONTINUED FROM PART 1 ...

In the same way, this statement of Abu Shawarib Wahabi can be studied in polemical reply in two parts:

Wahabis have considered this as an excellence of Abu Bakr and have no doubt in it.
Pay attention to the following text mentioned in sources approved by Wahabis:
Malik has narrated in Muwattah from Ayesha that she said:
Abu Bakr gifted his orchard having twenty date trees to Ayesha and when his end approached, he said to her: My daughter, by God, nothing after my death that you are having is more valuable to me and nothing is harder for me than your poverty. You have received twenty date trees from me that if from them you raise other trees also it would be for you and today all my properties are there for my successors; that is your two brothers and two sisters. You must distribute them according to the Book of Allah. Ayesha said: Father, I don’t have more than one sister and she is Asma. Who is the other sister? Abu Bakr said: Kharija (my slave girl) is pregnant with another daughter whom I can see.[1]
And also in many other sources, the same matter is mentioned. Now, we put the same question to Abu Shawarib Wahabi: Is Abu Bakr having sonography facility that he has given this information?

Secondly, with regard to some companions, they have narrated that they even spoke to angels and gave information of unseen. Were those companions able to give information of unseen, but the Messenger of Allah (s) could not give information about Mohsin and his martyrdom? Why Wahabis scholars don’t have any objection against the conveying of information of unseen by other companions?

A- For example:
The Holy Prophet (s) said: In the past nations, there were persons who gave information of the unseen and if there is such a person in my Ummah, it is Umar. As if revelation comes to him and the Almighty Allah and the angels speak to him and it is narrated that Abu Bakr said: It came to my mind that the child that Asma was supposed to give birth to would be a daughter and if does not happen, the inspiration would be useless.[2]
Like the report mentioned above there are innumerable reports with same subject matter in authentic books of Ahle Sunnat. For example it is mentioned in Sahih Muslim as follows:
Ayesha has narrated from the Holy Prophet (s) that he said:
In the past nations there were persons who gave information of the unseen and if there is such a person in my Ummah, it is Umar.[3]

B- Story of the call of Umar from Medina and it being heard by Muslim fighters in Fasa Shiraz is a well known story, which is mentioned in numerous books accepted by Wahabis and such is the popularity of this incident that it is also mentioned in books of grammar, but we would quote it from the book of Al-Bidaya wan Nihaya of Ibne Kathir Damishqi Wahabi:
Sariya bin Zaneem went on an expedition to Shiraz and launched an attack, but the soldiers of Fars and Kurd arrayed their ranks against him and a large number of them surrounded the Muslims. That night Umar saw their battle and their number in dream and became apprehensive of their consequences; that what they will do in the wilderness the following day. And there was a mountain in that place that if the Muslims take its support they would only have to be cautious from one side. The following day Umar summoned everyone to the Masjid and spoke to the people and informed them of what he had seen; then he called out to them from that same spot: O Sariya bin Zaneem, the mountain, the mountain. Then he turned to the people and said: The Almighty Allah is having soldiers who might perhaps convey this information to them. Muslims present in that battle did what Umar had said and the Almighty Allah also granted victory to them over the enemies and they conquered that city.[4]
There are many other sources approved and accepted by Wahabis, which contain the text of the same incident.[5]

C. Story of River Nile accepting the order of Umar, which Fakhre Raazi has mentioned in his Tafsir:
It is narrated that during the period of ignorance the flow of River Nile in Egypt used to stop every year once and it did not restart till a beautiful female child was not thrown into it. After the advent of Islam, Amr Aas mentioned this matter to Umar and Umar wrote on a slab: O flow of Nile, if you flow by the power of Allah, continue to flow and if you are flowing with your own power, we are not in need of you. After this slab was thrown into the Nile, it restarted and never stopped again.[6]

D- Story of earthquake in Medina and fear of the whip of Umar, which is mentioned by Fakhre Raazi:
An earthquake started in Medina. Umar hit the earth with his whip and said: O earth, take it easy by the permission of Allah, and the earth fell quiet and after that no earthquake ever occurred in Medina.[7]

E- Story of fire accepting the order of Umar:
There was a fire in some houses of Medina. Umar wrote as follows on a slab: O fire, stop by the command of Allah, and threw in into the fire and the fire was extinguished.[8]

There are many other instances also, which are mentioned in Ahle Sunnat sources among merits of companions and none are objected to. So it is necessary to ask Abu Shawarib Wahabi: Why have you not raised objection against any of them?

OBJECTIONS AGAINST HAZRAT FATEMAH ZAHRA (SA) AND THEIR REPLIES - OBJECTION NO 16 PART 1

Among the Wahabi satellite networks, the most active against Shia, is the most popular of them in the world having broadcasting center in London and named as Al-Mustaqila, which has in recent years, unleashed widespread propaganda against Shia.

This network, before the arrival of ‘Days of Fatima’ in 1386 solar year, for a long time and through widespread propaganda in form of subtitles, day and night, in all their programs, laid great emphasis on this topic. They announced: This year we shall invite a group of religious experts to once and for all prove false the claim of Shia regarding the martyrdom of Fatima, daughter of the Messenger of Allah (s). These claims would be refuted and we will prove that Shia do not even have a single authentic report to prove their stance. In this way we will put an end to the annual Azadari ceremonies during ‘Days of Fatima’.

Some days before announcing its program, this network announced: If from the Shia one can represent them to defend the claim of Shia about the martyrdom of Lady Fatima (s), we welcome him to take part in these programs and arrange debates.

Senior Shia personalities were informed of this, because this network was instigating the religious sentiments of Shia and Sunni and creating differences in Muslim society. Initially they did not pay attention and overlooked the poisonous publicity of this network; but when this network brought a scholar-looking man disguised as a Shia to make false attributions to Shia, it was from this point that some supreme jurists (Maraja Taqlid) and senior personalities of religious seminaries of Qom, including His Eminence, Ayatullah Uzma Makarim Shirazi, decided to depute Ayatullah Dr, Husaini Qazwini to this network and inform its viewers about the true beliefs of Shia and also participate in this debate to neutralize the recent conspiracy of Wahabis in creating controversy between Shia and Sunni and present the traditional reports proving the martyrdom of Lady Fatima Zahra (s) in that program before all the Muslims of the world.

The objections mentioned in that programs with perfect impudence and audacity, regarding the martyrdom of Lady Zahra (s), were in fact not objections, but audacity and insult to the holy being of the Holy Prophet (s). It was nonsensical talk, which came from a Wahabi participant in this debate, named Abu Shawarib from Egypt:

This Mohsin, which Shia say that the Messenger of Allah (s) named as Mohsin and who was martyred during the attack on the house of Fatima. How the Prophet came to know about the birth of this child years before the event and he named him Mohsin? Did anyone inform him about it or that the Prophet was having facility of sonography that he saw this child in the womb and also named him as Mohsin.

Below we present some replies of our respected teacher Ayatullah Dr, Husaini Qazwini, which were set forth in this program:

The Holy Prophet (sawa) was Informed About The Oppression During Meraj

"As for your daughter, she will be oppressed and deprived, and the rights which you gave her will be usurped. She will be beaten while she is pregnant, her sanctity will be breached, and her house will be entered without permission. Then she will be humiliated and disrespected. She will find no protector, she will suffer from a miscarriage because she will be beaten, and she will die as a result of that beating."

Hammad ibn Usman narrates from Imam Jafar Sadiq (as):Abu Abdillah [Imam Sadiq (as)] said:

When the Prophet (saww) was taken to the heavens on his journey (at night), he was told, "Verily Allah, the Blessed and the Exalted, will test you with three afflictions to see how patient you will be."

The Prophet (saww) replied, "I submit to Your command, O Lord. And I have no power to stay patient except through You. What are the three tests?"

He was told, "The first (test) is hunger and giving preference to the needy over yourself and your family."

The Prophet (saww); replied, "I have accepted, O Lord. I am pleased (with Your Will) and I submit to it, and I seek success and patience with You."

He was told:
The second (test) is that you will be belied and you will be in extreme fear (for your life). You should spend your wealth, your blood, and your soul fighting against the people of disbelief, you should remain patient when you will be harassed by the disbelievers and the hypocrites, and you should remain patient when you will be hurt and wounded in battles.

The Prophet (saww) replied, "I have accepted, O Lord. I am pleased (with Your Will) and I submit to it, and I seek success and patience with You."

He was told, "The third test is that your family will be killed after you. As for your brother, 'Ali, your nation will slander and rebuke him, they will be violent with him, they will deprive him and usurp his rights, they will oppress him, and finally they will kill him."

The Prophet (saww) replied, "I have accepted, O Lord. And I am pleased (with Your Will), and I seek success and patience with You."

He was told: As for your daughter, she will be oppressed and deprived, and the rights which you gave her will be usurped. She will be beaten while she is pregnant, her sanctity will be breached, and her house will be entered without permission. Then she will be humiliated and disrespected. She will find no protector, she will suffer from a miscarriage because she will be beaten, and she will die as a result of that beating.

OBJECTIONS AGAINST FADAK AND THEIR REPLIES -4

OBJECTION :

Hazrat Fatima Zahra (sa) assumed that Fadak was gifted to her

REPLY:

There is no contradiction over Sayyida Fatima (as) claiming Fadak as a gift and inheritance. The initial demand of Sayyida Fatima (as) was that Abu Bakr returns the land that had been gifted to her by her father. Sayyida Fatima (as) had the land in her possession but Abu Bakr ignored this and the written bequest of her father (s) and refused to return the land. Abu Bakr deemed the land as that of the Prophet which was in possession of his daughter held on trust as long as he (s) lived and which reverted back to the State upon his death. Sayyida Fatima (as) used this assertion to challenge Abu Bakr’s right to control the land. After all he usurped the land on the basis that it belonged to the Prophet (s). Sayyida Fatima (as) was still entitled to the land as the Legal Heir so she had every right to make a claim on this basis. Abu Bakr refused her claim that the land was under her control, and he also rejected her claim that she was her father’s Waris (legal heir). We shall now set out proofs that leave no doubt that Fadak was in fact land that had been given to Sayyida Fatima (as) as a gift.

Proof One

The greatest proof that Fadak had been given as a gift to Sayyida Fatima (as) by Rasulullah (s), lies in the fact that she already had possession of the land at the time of her father’s death. This would not have been the case if the land belonged to Rasulullah (s). Property which is given as a gift is handed over to the transferee at the time when gift is made (even before the death of the testator). Whereas the share in estate of deceased is taken hold of only after the death of the deceased. The fact that Sayyida Fatima (as) was already in possession of the land of Fadak at the time of The Prophets death clearly shows that this land was given to her as a gift in the lifetime of her father and there was no question of its being treated as a share in inheritance.
We read in al Milal wa al Nihal page 13, wherein Allamah Sharastani discusses the disputes that arose following the death of Rasulullah (s):

General facts on Fadak

What is Fadak?

For evidence as to how much area constituted fadak, we are relying on the following esteemed Sunni works:
  1. Maujam ul Buldan by Yaqoot Hamawi, v14, p238
  2. Tareekh Khamees, v2, p88
  3. Wafa-ul-Wafa by Noor-ud-Deen Al-Samhoodi, v4, page 1480

"Fadak was a city, which was situated 2 or 3 days of travel from Madina. There were wells of water and trees of dates in it. It was the same Fadak, about which Fatima Zahra (r) said to Abu Bakr, "My father gave me this Fadak as a present". Abu Bakr asked her in reply to produce witnesses."

Note: Upon this demand of Abu Bakr, Fatima (as) recited this verse of the Qur'an:

"Nay, but ye have yourselves contrived a story (good enough) for you. So patience is most fitting (for me).
