Who witnessed against Fatemah Zahra (sa) in the matter of inheritance?


(Qurb al-isnād (Arabic: قُرب الإسناد) is an an Imami hadith collection which is written by 'Abd Allah b. Ja'far al-Himyari, a Shiite scholar )


وعنهما ، عن حنّان بن سدير قال : سأل صدقةُ بن مسلم أبا عبدالله عليه‌السلام ـ وأنا عنده ـ فقال : من الشاهد على فاطمة بأنها لا ترث أباها؟ فقال : شهدت عليها عائشة وحفصة ورجل من العرب يقال له : أوس بن الحدثان ، من بني نضر. شهدوا عند أبي بكر بأن رسول الله صلى‌الله‌عليه‌وآله قال : لا اُورث. فمنعوا فاطمة عليها‌السلام ميراثها من أبيها صلى‌الله‌عليه ‌وآله


From Hanan bin Sadeer who said, Sadaqah bin Muslim asked Imam Sadiq (asws) while I was with him,

"Who witnessed against Fatema (sa) that She does not inherit from her father?"

Imam (asws) said, "A'ishah, Hafsah and man called Aus bin Hadasan from the tribe 'Bani Nadhr' testified in front of Abu Bakr that the Prophet (saww) said, "I am not inherited", and so they denied Fatemah (saw) her inheritance from Her Father (saww)."

The Incomparable Virtues of Fatemah Zahra (s.a.) in the Sunnah

The Incomparable Virtues of Fatemah Zahra (s.a.) in the Sunnah


Hazrat Faatemah (a.s.) is called Faatemah because nobody can fathom her position. The only way to get some insight into her august position is from the sayings of the holy infallibles (a.s.).
The following are some of the quotations from Sunni books listing her virtues and underscoring her status:

1) Cause of creation of the universe

Numerous Sunni narrators like Shaikh al-Islam al-Hamuee (exp 732 A.H.) has documented in his book Faraaed al-Simtain book 1, pg 36, from Ibne Abbas, who quotes from Holy Prophet (s.a.w.a.):
When Allah created Hazrat Adam (a.s.) and angels prostrated before him, Hazrat Adam (a.s.) asked Allah whether He had created anyone, dearer than him (Adam).
Allah replied: Yes. If they were not there, I would not have created you.
Then Hazrat Adam (a.s.) expressed his desire to see them. At the time, Allah ordered the Angels to set aside the curtain. Then Hazrat Adam (a.s.) saw five shadows in front of Allah’s Throne. He asked: O Allah! Who are they?
Allah informed: This is Muhammad (s.a.w.a.), this is his cousin and brother and successor, Ameerul Momeneen Ali (a.s.), and this is Faatemah (s.a.) the beloved daughter of My Messenger, and these are the sons of Ali and the Prophet, Hasan and Husain. Listen O Adam, they are among your sons.
Khwarazmi has quoted in his Manaaqib, that Abu Hurairah, has invited attention to this sentence – If they would not have been there you would not have been created. After this, Allah informed Adam that if they had not have been there, even Arsh and Kursi, skies and earth, angels, jinn and humans would not have been created. And for this reason Hazrat Faatemah Zahra (s.a.) is the cause of creation.

2) Love of Faatemah is condition of prophethood

Allah, the Almighty, presented the Wilaayat (mastership) of Ali (a.s.), Faatemah (a.s.) and their infallible progeny (a.s.) to the creation. Those who took precedence in accepting them were appointed prophets, after them came the Shias. Allah will gather all of them in Paradise. Many traditions on these lines are available in books like Basaaer al-Darajaat.

3) Leader of the women of this world and the hereafter

Ibne Maghaazali Shaafe’ee, in his book Manaaqib, pg 399, has documented a tradition from the Holy Prophet (s.a.w.a.): By the Almighty, who made me a Prophet, that you O’ (Faatemah (a.s.)) are the leader of all women in both worlds i.e. in this world, and the hereafter.
Many more traditions of this nature have been mentioned by Sunni scholars like Allamah Shahaabuddin Aalusi in Tafseer al-Maani, book 3, pg 155, Shaafe’ee in Seerah al-Halabi book 2, pg 6, as also by Suyuti, Muqrezi, Mannaawi, Ibn Abil Hadeed Motazali, Ahmed Zaini Vehlaan, Shaafe’ee Mufti Misri.

4) Affection and regard for Faatemah (s.a.) will serve at 100 stations

Shaikh al-Islam al-Hamuee in his invaluable book Faraaed al-Simtain, book 2, pg 67 has documented a tradition from the Holy Prophet (s.a.w.a.) that he (s.a.w.a.) informed Salmaan:
He who befriends Faatemah (a.s.) will be with me in Paradise and he who bears enmity with Faatemah will be in Hell. O Salmaan! Affection for Faatemah will rescue a person in 100 stations of which the least terrifying are death, grave, scale of deeds, resurrection, Seraat and accounting of deeds. He with whom my daughter is pleased, will benefit from my pleasure, and he with whom, I am pleased will benefit from Allah’s Pleasure. And he with whom Faatemah is angry, will incur my wrath and he with whom I am angry will be a target of Allah’s Wrath. Most deplorable is the one who tyrannizes Faatemah (s.a.) or her husband Ameerul Momineen (a.s.) or her sons or their Shias.

كتاب الطرف للسيد علي بن طاووس نقلا من كتاب الوصية للشيخ عيسى بن المستفاد الضرير

From" Kitab al-Turf" of Sayed ibn Taoos quoting from Kitab al-Wassiyah of Shaikh Isa bin al-Mustafaad al-Zareer

عن موسى بن جعفر، عن أبيه (عليهما السلام) قال

 Imam Musa bin Jafar al-Kazim (as) from his Father (as):


لما حضرت رسول الله (صلى الله عليه وآله) الوفاة دعا الانصار وقال … ألا إن فاطمة بابها بابي وبيتها بيتي، فمن هتكه فقد هتك حجاب الله "، قال عيسى: فبكى أبو الحسن (عليه السلام) طويلا، وقطع بقية كلامه  وقال: 
هتك والله حجاب الله، هتك والله حجاب الله، هتك والله حجاب الله يا امه صلوات الله عليها

"When Prophet Mohammad (saww) was about to die, He called the Ansaar's and said, ... "Indeed the door of Fatema (sa) is My door, and Her house is My house. So whoever disgraces it has disgraced the Hijaab (veil/covering) of Allah" (swt).

The narrator Isa then says, "Abu al-Hasan Imam Kazim (as) then cried for long and cut of 

rest of his speech and said,

  "By Allah (swt) the Hijaab of Allah (swt) was disgraced, 

By Allah (swt) the Hijaab of Allah (swt) was disgraced, 

By Allah (swt) the Hijaab of Allah (swt) was disgraced, 

O My Mother (sa)..."

LAMENTATION OF HAZRAT ZAHRA (SA) UPON IMAM HUSSAIN (AS)

It is written in the book Kamiluz Ziyarat ( chp 26 tdn no 7) : 



Abu Basir says: I was speaking with Imam Sadiq (a.s.) when one of his sons entered. Imam (a.s.) said: ‘May Allah bless you’; and then embraced and kissed him.

Then he (as) said: ‘May Allah degrade those who dishonored you. May Allah avenge those who oppressed you. May Allah disappoint those who deserted you. May Allah curse those who slain you. May Allah be your guardian, protector and helper. Prophets, truthful ones, martyrs, angels of the heavens and our ladies have been weeping on you’.

Then Imam (a.s.) began to weep and said: ‘Abu Basir, when I look at the children of Imam Husain (a.s.), grief overcomes me when I remember what was meted out to them and to their father.’
‘Abu Basir, Fatima (s.a.) weeps and laments over Husain (a.s.) as a result of which Hell sighs so intensely, that if the keepers of Hell who also hear her voice did not prepare themselves to restrain it, it would burn all the inhabitants of the earth with its blazing fires and sparking fumes. So the keepers restrain it and hold its doors tightly closed as long as Fatima (s.a.) laments. Because they fear for the inhabitants of the earth. But Hell is not pacified until Fatima’s lamentation ends.’

‘Abu Basir, the seas almost split apart and collide with each other. There is a dedicated angel for every drop of water and they prevent every drop from boiling with their wings; keeping it together because of their fear for this world and everything in it. The angels remain in fear and cry for her crying. And they pray to Allah and beseech Him, after which the inhabitants of the Arsh and those around it beg Allah.’


‘Then their voices are raised in glorification of Allah, all because of their fear for the people of the earth. Even if one of their voices reached the earth, all the inhabitants would swoon, mountains would crumble and the earth would shake with its inhabitants.’

Abu Basir said, “May I be sacrificed on you! It is really a serious matter.”
Imam (a.s.) said, “That which you have not heard is greater. Abu Basir! Don’t you want to be of those who support Lady Fatima (s.a.)?”
When I heard this, I cried so much that I could not speak nor could the Imam (a.s.) do, because he was crying so intensely. Then he went to his prayer room and began to recite a supplication.

So I left the Imam in that state. I could not eat or sleep that night. The following morning, I was fasting and was in extreme fear when I went to Imam (a.s.). I heaved as sigh of relief when I saw that he had calmed down; and I praised and glorified Allah, because no chastisement or calamity had befallen me

Janabe Fatema Zahra (s.a.) and remembrance of Imam Mahdi (a.t.f.s.)

"On the occasion of the Wiladat of our Master Hazrat Imam Mahdi (a.t.f.s.) 

15th Shabaan 1439 AH (2018)"

Arful Wardi Fee Akhbaril Mahdi’ (vol. 2, p. 166) and ‘Jam’ul Jawaam’e’ by Hafiz Jalaaluddin Suyuti (vol. 1, p. 5) report this narration from Aabri that :

Imam Muhammad Baqir (a.s.) reports from his father, Imam Zainul Abedeen (a.s.) and he from his father till the narration reaches Janabe Fatemah Zahra (s.a.) who reports,

The Holy Prophet of Islam (s.a.w.a) said," O Fatemah! I give you glad tidings of Mahdi. He is from your progeny."




Mahmood Ibn Labeed narrates:

“After the demise of the Holy Prophet (s.a.w.a.) Janabe Fatema (s.a.) used to visit the graves of the martyrs and Janabe Hamza (a.s.) and wept inconsolably. I asked her: O Leader of all women! Your weeping has broken my heart into pieces. She replied: ‘O Abu Amr! My grief is justified. I am mourning my separation from the best of among fathers and how fervently I crave his meeting’ I asked: Did the Holy Prophet (s.a.w.a.) declare the Imamate of Imam Ali (a.s.)? She said: ‘It is strange that you have forgotten Ghadeer.’ I said: I remember Ghadeer but I want to hear what the Holy Prophet (s.a.w.a.) has spoken to you. She said: ‘I swear by Allah that I have heard this from the Messenger of Allah (s.a.w.a.) – ‘Ali (a.s.) – whom I am making my successor – is the best amongst you. He is the leader and my successor and then his sons Hasan (a.s.) and Husain (a.s.) and nine Imams from Husain (a.s.)’s progeny. If you follow them you will find them as guides and will be rightly guided. And if you oppose them, you will be involved in discords and disagreements among your selves till the Day of Judgment’.’  I asked: O Lady! Why will they hold their silence? She (a.s.) explained: ‘An Imam is similar to the Holy Kaaba. The Holy Kaaba has to be visited; it does not come to you.’ Then she (a.s.) continued: ‘By the Almighty, if truth remained in its proper place there would be  no differences among even two men – till this caliphate would succeed one after the other and the ninth son from the progeny of Husain (a.s.), i.e. our Qaem (a.t.f.s.) would reappear.’

Ameerul Momineen (a.s.) did not take back Fadak due to divine reward and punishment

Imam Sadiq (a.s.) informs us why Ameerul Momineen (a.s.) did not take back Fadak on assuming
caliphate.
He narrates: Ali (a.s.) did not take it back because the oppressor and the oppressed (Hazrat Fatima Zahra s.a.) had already set forth towards Allah, the Almighty. Allah had rewarded the oppressed (for patience) and had punished the oppressor (for usurping). Then Ali (a.s.) did not wish to take back something for which Allah had already punished the oppressor and had rewarded the oppressed.

Haroon killed Imam Moosa Kazim (a.s.) over Fadak

The debate over Fadak ownership began immediately after the martyrdom of the Holy Prophet (s.a.w.a.).
But the repercussions of the debate were felt for decades since the rulers were always anxious that Aal Muhammad (a.s.) would stake a claim over it.
The following incident involving Imam Moosa Kazim (a.s.) and Haroon underscores this reality.
Haroon al-Abbasi used to tell Imam Moosa Ibn Jafar (a.s.) take Fadak since I wish to return it to you. But he (a.s.) always declined the offer.
Haroon insisted on it upon which Imam (a.s.) said – I will not accept it until it is reinstated completely with all its limits.
Haroon asked – And what are its limits?
Imam (a.s.) – If I define its limits you will never return it.
Haroon – By your grandfather you must define it.
Imam (a.s.) – As for the first limit it is Aden (Yemen). Haroon’s face changed colour.
Haroon asked Imam (a.s.) to continue.
Imam (a.s.) – The second limit is Samarqand (Uzbekistan).
Haroon’s face turned even darker.
Imam (a.s.) – The third limit is Africa.
Haroon’s face turned black. He said – Continue.
Imam (a.s.) – The fourth limit is the sea coast along the peninsula and Armenia.
Haroon – There is nothing left for us.
Imam (a.s.) – I had already told you that if I define its limits you will never return it.
It was then that Haroon decided to kill Imam Moosa Kazim (a.s.).

When Fadak came back to haunt Ayesha

In the dispute over Fadak, the rulers very conveniently presented a forged tradition to the effect that 
prophets do not leave behind any inheritance – everything they leave behind is for the nation.
Among the witnesses of the forged tradition was Ayesha and Hafsa, along with Malik Ibn Aws, a Bedouin.
Usman reminds Ayesha of her false testimony
It is related by Tabari and Thaqafi in their respective history compilations:
During the tenure of Usman, Ayesha approached him and demanded:
Grant me (the pension) bestowed upon me by my father Abu Bakr and then by Umar.
Usman retorted: I have found nothing in the Book and the Sunnah to back this grant. Rather your father and Umar granted it to you on a whim, but I will not do so.
She demanded: Grant me my inheritance from Allah’s Messenger (s.a.w.a.)?
Usman shot back: Didn’t Fatima (s.a.) approach you to seek her inheritance from Allah’s Messenger (s.a.w.a.)? But you testified along with Malik Ibn Aws al-Basri (al-Nazri) that – ‘Surely the Prophet (s.a.w.a.) did not leave inheritance. In this way you usurped the right Fatima (s.a.) sought from you.’
I will not grant you (the inheritance).
Tabari reports further – Usman said – Weren’t you (Ayesha) the one, along with the Bedouin who used to perform ablutions with his own urine, to testify near your father that the prophets do not leave anything as inheritance?

Clearly Ayesha by claiming inheritance of the Holy Prophet (s.a.w.a.) rejected her own previous testimony. Even to a person like Usman, the contradiction in her stand was obvious, as was the motive behind her false testimony – to deprive Hazrat Fatima Zahra (s.a.) of her inheritance.

Greatest fear of the rulers: Fadak today, Caliphate tomorrow

It is evident from the dispute over Fadak that Hazrat Fatima Zahra (s.a.) held the upper hand.
In fact she staked her claim with such forceful arguments and irrefutable testimonies that according to some reports, the ruler of the time was compelled to issue a written decree granting her Fadak.
The all-important question is – why were the rulers so nervous about handing over Fadak to Hazrat Fatima Zahra (s.a.)?
Ibn Abil Hadid has tackled the dilemma of the rulers in his Sharh Nahj al-Balaghah.
He writes:
One of the teachers of Baghdad was asked – Wasn’t Fatima (s.a.) truthful in her claim?
Teacher replied – Yes.
The person asked – Then why didn’t Abu Bakr hand over Fadak to her while she was truthful?
Teacher – If he were to grant her Fadak based solely on her claim, then certainly she would have approached him the next day and claimed caliphate for her husband. And in this way she would have displaced him from his position (as ‘caliph’).
Then it would no longer be possible for him to offer an excuse as he had already noted that she was truthful in all her claims.
Ibn Abil Hadid mentions that this dialogue is correct.

Clearly the rulers deprived Hazrat Fatima Zahra (s.a.) of Fadak as their own position as ‘caliphs’ would have been endangered.

Ameerul Momineen (a.s.) sufficient as sole witness on Fadak: Example of Khuzaimah

In the dispute of Fadak, the rulers insisted that Hazrat Fatima Zahra (s.a.) present two male witnesses (or
equivalent female witnesses). When Hazrat Fatima Zahra (a.s.) presented Ameerul Momineen (a.s.) as witness they rejected his testimony as biased and insisted on other / credible witnesses.
This she (s.a.) did, but those witnesses were also dismissed.
Sole testimony of Ameerul Momineen (a.s.) was sufficient for Fadak
Fact of the matter is that there was no need for rulers to insist on two (male) witnesses when one was enough.
The personality of Ameerul Momineen (a.s.) should have sufficed as a lone witness.
Leave alone Ameerul Momineen (a.s.), by consensus of both sects, Khuzaimah Ibn Thabit was titled Zu-Shahadatain (owner of two witnesses) by the Holy Prophet (s.a.w.a.) as he considered his witness equal to two witnesses.

Others like Abu Zarr, were also known for their truthfulness and the Muslims of the time never doubt his word.
The Holy Prophet (s.a.w.a.) informed:
‘…the green sky has not sheltered, nor has the earth carried a more truthful one than Abu Zarr.’

The credentials of Ameerul Momineen (a.s.) are far higher than those of all other Muslims put together so demanding an additional witness to back his testimony is plain ignorance and stubbornness.
Ameerul Momineen (a.s.) will never deviate others on any issue..and that includes Fadak

Is Hazrat Fatima Zahra’s (s.a.) stepping out of the house like Ayesha’s coming out in Jamal?

The opponents are quick to raise objections against Shias and quicker still to attack Aal Muhammad (عليهم‏ السلام).
One of their objections against the infallibles is:
Hazrat Fatima Zahra (سلام‏ اللّه عليها) stepped out of her house to secure Imam Ali Ibn Abi Talib (عليه السلام) without permission of her husband and this is just like Ayesha coming out in Jamal.
If Ayesha was wrong in coming out without permission, then Hazrat Fatima Zahra (سلام‏ اللّه عليها) was also in the wrong (God Forbid).

1. Securing the Imam vs Fighting the Imam

Hazrat Fatima Zahra (سلام‏ اللّه عليها) stepped out of the house to secure her Imam and husband from oppressors.
Ayesha came out in open confrontation to fight and possibly kill the Imam and unanimously elected caliph.
We fail to see how the two instances are even remotely comparable!

2. Ayesha cannot be compared to Hazrat Fatima (s.a.)

The two personalities cannot be compared for the simple reason that there is divine text (nass) for Hazrat Fatima Zahra’s (سلام‏ اللّه عليها) purity and infallibility in Verse of Purification (Tatheer) that even Ahle Tasannun scholars like Muslim Nishapuri have documented, while there is nothing in favour of Ayesha’s infallibility and purity.
Also, there is consensus among scholars that Hazrat Fatima Zahra (سلام‏ اللّه عليها) is the chief of women of paradise while there is nothing to that effect for Ayesha.
This much is enough to end the discussion in favour of Hazrat Fatima Zahra (سلام‏ اللّه عليها). Given her infallible status and standing as chief of all women, Hazrat Fatima Zahra (سلام‏ اللّه عليها) broke no law or moral code in this matter or any other matter, while the same assurance does not exist for Ayesha.3. Wives are prohibited from coming out of the house
There is consensus among scholars of both sects based on the Quranic verse that the wives were ordered to stay confined to their houses.
‘And stay in your houses and do not display your finery like the displaying of the ignorance of yore…’
  • Surah Ahzab (33:33)
Ayesha was duty-bound like other wives (e.g. Umme Salma (r.a.)) to remain confined to her house. By venturing out of the house she has violated a clear Quranic injunction.
Those who maintain that this command was restricted to the lifetime of the Prophet (صلّى اللّه عليه و آله‏ و سلّم) are unable to furnish proof from the Quran or the Sunnah to support their claims.
Such a prohibition for stepping out of the house did not bind Hazrat Fatima Zahra (سلام‏ اللّه عليها), so comparing her with Ayesha in this context is meaningless.
